EU Data Act: Switching, Portability and Access to Your Data

What Regulation (EU) 2023/2854 means for MousePlayer as a cloud service, how you switch away or take your data with you, and where our infrastructure is subject to which law. Last updated 16 October 2026.

1. Which parts of the Data Act apply to MousePlayer

The Data Act (Regulation (EU) 2023/2854) applies since 12 September 2025. MousePlayer is a data processing service within the meaning of Article 2(8) - a software-as-a-service offering. The provisions that matter for you as a customer are therefore those of Chapter VI (switching between data processing services, Articles 23 to 31) and Article 32 (international governmental access), together with the interoperability rules of Chapter VIII.

  • Chapters II and III (data from connected products and related services) do not apply: MousePlayer is not a connected product and does not process data generated by one.
  • Chapter IV (unfair contractual terms, Article 13): in our assessment, our Terms of Service contain no term of the kind listed there; we do not exclude liability for intentional breach or gross negligence (clause 21.1), and we do not prevent you from obtaining or using your own data.
  • Chapter V (data for public bodies in exceptional need): we hand over data only on a lawful, specific request, and we inform the affected customer where the law allows it.

Personal data first. The Data Act does not override the GDPR. Recordings of your visitors are personal data that you control and we process on your behalf under the Data Processing Agreement. Everything on this page about export and switching applies within those limits.

2. Switching away from MousePlayer (Articles 23 to 27)

You may terminate and switch to another provider or to your own systems at any time. In line with Article 25 we commit to the following; the contractual rules are set out in clauses 9.2, 24.1a and 24.2 of our Terms of Service:

  • Notice period. Termination takes effect at the end of the current billing period, never later than two months after your notice.
  • Transition period. When a paid subscription ends, your account is not closed but moves to the free tier. For 30 days the retention period of your previous tier still applies to your existing data, after that the one of the free tier. The account remains accessible, exports through the account (account export, CSV export) remain possible, and recording continues within the limits of the free tier; projects above its limit are paused. The REST API and MCP access are currently available only on the Business and Enterprise tiers. If an export is technically not feasible within this period, we tell you, name the reason and extend the period in which the previous retention applies once by the time needed, to at most seven months.
  • Assistance. We answer switching questions through the support form and provide the export formats described below without an additional order.
  • Erasure. The end of a subscription deletes nothing that does not fall away anyway under the retention periods of the free tier. If you want all data deleted, start the deletion of the account in the account settings: the account is first archived for 30 days and can be restored during that time; after that it is deleted for good, or immediately if you choose so. An account on the free tier in which nobody has signed in for 24 months is deleted after a warning by e-mail if no sign-in follows within 30 days.
  • No switching charges. We charge nothing for terminating, exporting or migrating, neither now nor after 12 January 2027, when Article 29 makes this mandatory. There are no data egress fees.
  • No obstacles. No contractual, technical or commercial measure ties you to MousePlayer: no minimum term beyond the paid period, no proprietary format for your data, no penalty for leaving.

3. Exportable data and formats (Articles 26 and 30)

The exportable data within the meaning of the Data Act - the input and output data of your use, including metadata - can be exported in structured, commonly used, machine-readable formats; security secrets such as password hashes and keys are excluded. The categories and the available ways:

CategoryFormatWay
Projects and segmentsJSONREST API and MCP access, Business and Enterprise tiers (API documentation)
Goals, funnels, project settingsJSONFull export on request. The REST API has no endpoint for these.
Sessions with metadata (device, source, campaign, country, duration, pages)CSV / JSONCSV export from the User Explorer (all tiers); REST API and MCP access (Business, Enterprise); BigQuery export
Reached goalsJSON, one object or row per goalIntegrations for object storage (S3-compatible, Azure Blob), Google Sheets, SharePoint and webhooks
Survey responsesCSVCSV export in the “Surveys” tab
Events (clicks, scrolls, movement, custom events with parameters)JSON / NDJSONREST API per session (Business, Enterprise); BigQuery export; full export on request
Recordings (DOM snapshots and mutations)HTML and JSONFull export on request; each recording can also be opened as a share link
Heatmap aggregates, AI features and profiles, insightsJSON / CSVFull export on request
Account, workspace, members, invoicesJSON (ZIP), PDF (invoices)Account export in the settings (all tiers, password required); billing page; export on request

A full export is a request through the support form with the reason "Other" and the words "Data Act export". It is delivered as an encrypted archive within the transition period, in most cases within a few working days. Open formats and documented field names mean that no specific tool is needed to read the export.

Functional equivalence (Article 30(1)) is an obligation for infrastructure services and does not apply to a software service like MousePlayer. For the obligation that does apply (Article 30(2)) we provide the documented REST API and, free of charge for all customers, the account export, the CSV export and the full export on request.

4. Jurisdiction of our infrastructure and governmental access (Articles 28 and 32)

  • Location. MousePlayer runs on our own hardware in Poland. There is no cloud provider between you and us. The daily backup is stored, encrypted before transfer, at the location named in the list of sub-processors.
  • Applicable law. MousePlayer's servers and machines are subject to Polish law and the law of the European Union. For the outsourced, encrypted backup and for individual sub-processors (payment processing, e-mail delivery, domain management, spam protection), the law of a third country in which the provider concerned is established may apply as well; the backup keys do not leave our server (clause 24.5 of the Terms of Service).
  • Requests from third-country authorities. We comply with a decision of a third-country court or authority only where it is recognised under an international agreement or under the conditions of Article 32(3). We examine every request before any disclosure, obtain an interpretation from the competent body of the Member State where necessary, and disclose only the minimum possible (clause 24.5 of the Terms of Service). Where we are permitted to, we inform the affected customer before disclosure.
  • Technical and organisational measures against unlawful access are described in our Technical and Organisational Measures: encryption of all connections from the internet and of backups, access control, logging, and the masking of visitor input according to the project's masking level before it leaves the browser.

5. Interoperability (Chapter VIII)

Our interfaces use open, documented formats (JSON over HTTPS, documented in the API documentation). Session identifiers, timestamps, URLs and event names follow common conventions that other analytics tools can read; you can name your own events using the GA4 event vocabulary. We will review harmonised standards or common specifications for data processing services and implement them once they are published and apply to us.

6. Contact

Questions about switching or exporting, and switching requests themselves, go to the support form or to office@mouseplayer.com. If something goes wrong on the way, the complaints procedure applies.
